Current Report No. 4/2026
With reference to the current report No. 24/2025 of 9 October 2025 on the ruling of the Supreme Administrative Court, in which the court dismissed the cassation appeal of the Head of the Małopolska Customs and Fiscal Office in Krakow and the cassation appeal of the prosecutor, recognising ineffective suspension of the course of the statute of limitations for all tax liabilities in ZM SILESIA S.A, a subsidiary, covered by tax proceedings on the tax on goods and services for the period from January 2015 to June 2015, the Management Board of Boryszew S.A. advises that on 9 February 2026 it became aware of issuing on 5 February 2026 by the Head of the Customs and Fiscal Office in Krakow in the appeal proceedings, the decision revoking the decision of the first instance authority in its entirety and discontinuing the above mentioned tax proceedings. The decision finally ends ZM SILESIA S.A.’s VAT dispute for the first half of 2015.
